Looking for a Real Estate Lawyer?  My offices offer real estate closings in the GTA, Durham, Peterborough, Bancroft and surrounding areas all out of our Whitby law office and Apsley Law Office.  We may have started as Whitby lawyers, but now we are mobile and able to help you throughout southern and eastern Ontario!

Whether you are buying or selling a home or other real estate, you will need a competent and efficient law office to complete your transaction. Call my office if you have questions about our fees, disbursements, and the process of closing a real estate deal. Open and reliable communication with your lawyer and the law office staff is imperative to making sure you are comfortable and prepared for your closing.   We will also help you calculate the Land Transfer Tax if you are purchasing, and will decipher whether or not you qualify for the rebate as a First Time Home Buyer. If you signed your agreement with an agent:

For a handy interpretation of the terms of the standard form of an Agreement of Purchase and Sale , here is a link to the OREA forms (https://www.orea.com/). However, nothing beats having your Agreement reviewed by your lawyer before signing that deal, or before the deal goes firm. Don’t forget to ask about the costs associated with working with an agent (if you are the seller), make sure to ask about the total amount of their fees, plus HST.

NEED ILA (independent legal advice)? I love referrals, but its important to know that your lawyer is an independent party to your transaction and therefore completely on your side! It’s important to be able to find your own representation so don’t be afraid to find your own lawyer that can provide truly independent legal advice.

If it’s a private sale:

If you have managed to find a buyer/seller without utilizing an agent, you still need a properly drafted Agreement of Purchase and Sale, drafted by someone with years of experience in drafting and reviewing these documents. My office is equipped with the latest legal documentation for these agreements. If you are the buyer, the seller will need independent legal advice on the agreement, and vice versa.

Are you considering Transferring the Family Home to a loved one?

This is a very important decision and should not be made lightly. It is best to meet with a lawyer whom will review the different circumstances and consequences of transferring your property to any member of your family. You should also connect with your accountant or financial planner to discuss the financial consequences to your estate of transferring your property to any member of your family.

Refinances

Most Mortgages are set for a specific period of time, and eventually, you may either wish to renew with the same lender or perhaps you wish to refinance with a new lender. Either way, you will need a lawyer to complete this transaction as well. Our fees are highly competitive even though we complete the transaction for both you and your financial lender (if it’s a public institution).

What makes my office different?

We work closely with your agents in understanding your agreement, and we work closely with you, to make sure that you understand your own rights/obligations prior to and at closing.

When you come in to sign for your closing, you will meet with me personally, especially if it is your first time buying or selling a home. I am happy to answer your legal questions, and take the time to make sure that you do not leave the office wondering about what you just signed.

My experience with Central Ontario’s cottage country properties is unique in that I have the flexibility of being able to meet with you in two locations, in the Heart of North Kawartha, and if you need to meet closer to home, in the Whitby Office.
